Professor Bernie Ward, May He Rest in Peace, Would Have Loved ItWhile Charles Allen Wright was better known, Bernie Ward was an equally talented federal courts scholar at the University of Texas Law school when I was a student. I had Professor Ward and still marvel at the quality of his lectures and his interest in the fine jurisdictional distinctions related to the federal courts, which we were frequently reminded are 'courts of limited jurisdiction.' While I have doubts that many will relish wading through Judge Easterbrook's opinion in
Baker v. IBP, Inc. (7th Cir. 4/4/04) [pdf], Professor Ward would have loved at least the initial discussion on why the district court was wrong to find that it lacked jurisdiction.
Professor Ward may not have been as interested in Judge Easterbrook's continuing dissertation over the economic problems with plaintiffs' case, which ultimately lead him to find it should be dismissed for failure to state a claim on which relief could be granted.
Almost lost among all the jurisdictional and law and economic writing is an unusual set of allegations - that IBP, acting with others, was depressing the labor market by knowingly hiring illegal aliens, going so far as to allege that IBP would notify these workers on days when the INS might appear. (Judge Easterbrook wryly notes that the complaint fails to state how IBP knows of such dates.) This was a violation of RICO according to the complainants.
But for reasons you will have to read the opinion to discern, not a claim that could be successfully made as a legal matter.

An Appropriate Case For Intentional Infliction of Emotional DistressThe tort of intentional infliction of emotional distress is not a favorite of mine, and absent tight judicial control that can easily turn into a code of civility, of the type that courts so frequently note does not exist. Nevertheless, there are rare fact situations where even I would be hard pressed to deny that such a claim might exist.
Gantt v. Security, USA, Inc. (4th Cir. 1/23/04) [pdf] is such a case.
Gantt, a security guard obtained a restraining order against her boyfriend. Her week-end supervisor who also was her boyfriend's supervisor at another security company during the week, sent her to a job assignment knowing that she would be exposed to her boyfriend. Even after he called and threatened Gantt, the supervisor refused to remove her. After Gantt was kidnapped, raped and held captive for 6 hours by the boyfriend, she sued the company for among other things, the intentional infliction of emotional distress. The facts seem to me to be the very narrow exception that the tort was designed to cover. Even here the company may, and perhaps under the law of Maryland should, escape liability. The claim might fail because of the workers' comp bar as interpreted by Maryland courts, or the supervisor might not be at a sufficient level to bind the company vicariously, both are mentioned as possibilities in the opinion. But just on the question of whether the underlying facts state a cause of action, this one does not offend. At least not me.

I've been working as a programmer for about 8 years now. Mystarting salary 8 years ago is significantly more than mostnon-techies i know make even today. Yet over the last 8 years, I'veseen an average 10% increase in salary. (that's more than a 150%eincrease)
Certainly my ego wants to believe that my l33t skillz are worthsuch a premium, but I see an end coming. This year was the first yearthat I didn't see a large year over year salary increase. I changedjobs last August with only a token increase in pay. (actually, withthe decrease in benefits, it probably comes out to a net loss)All this makes me wonder if perhaps, at 30, if my salary has peakedas a programmer with no management responsibilities.
In real terms, I think tech salaries have nowhere to go but down.As much as I'd like it to be otherwise, I don't see any businessjustification for programmers to demand such high salaries across theboard. It's only a matter of time before free market forces pullthings down.
